TN Visa: Work in the U.S. as a Canadian or Mexican Professional

Temporary Employment Opportunities Under the USMCA Agreement

What is a TN Visa?

The TN visa is a nonimmigrant visa that allows qualified professionals from Canada and Mexico to work in the United States temporarily. This visa is part of the United States–Mexico–Canada Agreement (USMCA), which replaced NAFTA in 2018. The TN visa is ideal for citizens of Canada and Mexico seeking employment in a specific list of professional occupations in the U.S.

Eligibility Requirements for a TN Visa

To qualify for a TN visa, applicants must meet specific criteria:

Citizenship of Canada or Mexico

The applicant must be a citizen of either Canada or Mexico to qualify for a TN visa.

Temporary Employment

The applicant must plan to enter the U.S. temporarily to work in a pre-approved occupation.

Minimum Qualifications

You must have the necessary qualifications for the profession listed in Appendix 1603.D.1 of the NAFTA treaty. Most positions require a bachelor’s degree, and some may require specific licensure.

TN Visa Holders' Responsibilities

Once you obtain your TN visa, it is important to comply with all the conditions:

Work in Approved Employment

You are only allowed to work in the specific TN employment described in your application.

Maintain Ties to Your Home Country

You must show intent to return to Canada or Mexico and maintain permanent ties to your home country.

Restrictions on Immigration Intent

TN visa holders cannot accept tenure-track faculty positions or intend to immigrate permanently to the U.S.
